How much jail time might someone get for failing a drug test?

My boyfriend just got back from prison in august of 2006



He was charged with possesion of a controlled substance, (meth), and spent 6 months in the idaho department of corrections. He ran into his P.O today and his P.O wants to have him take a hair follicle test. Which im guessing he will fail because at this point in time he has been occasionally smoking pot, he hasnt been doing any other drugs, but obviously he has a record so it might be worse. Does anyone have a guess on how much jail time do you think he might get?

When trying to figure out the amount of time he'll do, consider the following: 1) his prior criminal history; 2) his trackrecord when it comes to compliance with supervision (previous probationary periods, and how long he managed to succeed on parole); 3) dangerousness to society and likelihood of reoffending; and 4) stability of life on the outside (job, family support system, etc.). These are all factors the parole board will consider when deciding his fate.



Thus, if he is young, doesn't have an extensive criminal record, is a non-violent drug offender, is working in the community, and has been otherwise following the terms of his parole, he can likely expect leniency.

you deserve better than a guy like this. if he wants to go straight he can't be smoking pot. you should really get rid of this guy.

I will not approach this with the typical shallow hatefulness seen by the hysterical masses after all he is a human being:



They will revoke his probation and its unknown how much time he will get. If he fails and admits to the use he will probably fair better than trying to fight it at this point. Good thing he won't test positive for meth. If he does, it will be much much worse I would think. The job of a probation officer is to make sure he is in compliance with the law. You can bet if he went down for drugs he will be randomly tested all the time. Any use at all will get him busted. The best motto now is remorse and compliance. This is his only chance to stay free.

Question the test though: rather than smoking pot he has been hanging out with persons who do. This will generate a false positive. ONLY if his parole terms allow for this of course.
